Welcome! These Terms and Conditions (“Terms”) explain how you can use our website and purchase our Squarespace templates and other digital products (“Products”). Please read them carefully—using our website or buying from us means you agree to these Terms.

By using this website or purchasing our digital products ("Products"), you agree to these Terms and Conditions (“Terms”).

The terms “we”, “us”, and “our” refer to Nikol Bodnarova Photography trading as Visual Charm Web Design.
“You” refers to any visitor, customer, or user of our website and Products.

“Content” includes everything on our site (text, graphics, templates, images, etc.).
“Products” refers to digital items such as Squarespace templates and design resources.

2. Acceptance of Terms

By visiting our website, downloading free resources, or purchasing a Product, you agree to these Terms.
We may update these Terms at any time. The newest version will always be posted on this page.

3. License & Usage Rights

Purchasing a template grants you a license to use it—not ownership.

You MAY:

  • Use the template for one website (personal, business, or client).

  • You may customize the template to fit your branding and content.

  • If you purchase on behalf of a client, the license is granted to that client for one project.

You MAY NOT:

  • Resell, share, distribute, or give away the template in any form.

  • Claim our template or design work as your own.

  • Use the template to create derivative templates for sale.

  • Use the template illegally or in a way that violates intellectual property laws.

To reuse the template for another client or project, a new license must be purchased.

Additional Template Usage Restrictions

When purchasing and using any of our templates, you agree to the following additional conditions:

  • If you use the template to build a website for a client, you must not claim the design as your own original work or present it as solely your creation.

  • You may not resell, redistribute, sublicense, or otherwise transfer the template or any of its components. Ownership of the design remains with us.

  • You are not permitted to share the template files, graphics, or design elements included in your purchase with any other person or business. Each license applies to one user and one project only.

  • Any photographs included in the template are for demonstration purposes only and remain the property of their original creators. You are responsible for replacing all sample images with your own properly licensed photographs. We accept no liability for image licensing issues resulting from the misuse of demonstration imagery.

  • All template designs and included digital files (excluding third-party imagery or pre-made graphics) are copyrighted materials owned by Nikol Bodnarova Photography, trading as Visual Charm Web Design.

  • We may showcase your completed website created with our templates in our portfolio, template galleries, marketing materials, sales pages, and on our social media accounts for promotional purposes.

    Squarespace Template Policy

  • When you purchase a Squarespace template from us, you will receive a link allowing you to add the template as a new website within your Squarespace account.

  • We aim to deliver your template within 48 hours of purchase. While we make every effort to meet this timeframe, delivery may occasionally be delayed due to unforeseen circumstances, weekends, or holidays. If you have not received your template after 48 hours, please submit a support request so we can assist you.

  • Each template purchase includes one delivery of the chosen template. If you accidentally modify or delete parts of your template and need it resent, or

    You do not accept the invitation to your new template within 12 months and the trial expires, you will be required to repurchase the template so we can prepare and send a new installation.

  • Your template will appear in your Squarespace account as a free trial website. If the trial expires, Squarespace may schedule the site for deletion. Should your site be deleted, and you need the template resent, a new purchase will be required. To avoid losing access, you should either request a trial extension from Squarespace support or upgrade to a paid plan. If you purchase both a Website Template and Add-on Pages, they will be delivered together as a single website.

Font Licensing & Demo Appearance

  • All website templates are transferred using the standard, built-in Squarespace fonts to ensure full compatibility and proper licensing. The premium fonts shown in the demo are not included, as they are licensed assets that must be purchased individually by each customer.

  • If you would like your website to match the exact look and typography used in the demo, you will need to purchase the same licensed fonts yourself from their official creators. With your template purchase, you will receive a guide that includes direct links to purchase the correct font licenses safely and legally.

  • Once you have purchased the fonts:

    • You may send the font files to us, and we will install them on your website for free, or

    • You may install the fonts yourself by following the step-by-step instructions provided in the guide.

  • Using licensed fonts is entirely optional, and your website will function perfectly with Squarespace's free built-in font library. Licensed fonts are only required if you wish to recreate the exact typography style seen in the demo.

Responsibility After Product Installation

  • Once the template has been installed on your website, it becomes fully integrated into your site and is no longer under our control. You are responsible for adding your own content, customizing the design, and maintaining the website moving forward.

  • If you make accidental edits or changes to the template after installation, we cannot access your site to reverse, undo, or restore those changes. Any corrections needed after installation are solely your responsibility.

4. Payments

By purchasing, you agree that:

  • Your payment information is accurate and authorized.

  • You will pay the full price listed at checkout, including any applicable taxes.

  • Prices are listed in USD and may change without notice.

5. Delivery of Digital Products

Products are delivered digitally. Because our Products are digital downloads, all sales are final. Once you receive the template, we cannot issue refunds or exchanges.

After purchase, you will:

  • Receive a download link, OR

  • Receive instructions via email to access your template.

Delivery is complete once the Product becomes accessible to you.

By accessing or downloading the digital Product, you acknowledge that you waive your EU right of withdrawal for digital content.

6. Refunds & Exchanges

All sales are final due to the nature of digital products.

Refunds are only considered in cases of:

  • Duplicate accidental purchases

  • Technical errors are preventing access to the Product

7. Support Policy

What’s included:

  • Email support for 1 month (exclusively for templates purchased from our shop).

  • Help with questions or technical concerns related to your template itself

  • Guidance on if something behaves unexpectedly or if you need clarification on how a feature works

  • Assistance if anything unpredictable appears along the way — ensuring your template continues to function as intended

Support does not include:

  • Uploading or organizing your content (images, copy, products, blog posts, etc.)

  • Custom design, layout adjustments, or creating pages that weren’t part of the template

  • New feature requests, coding modifications.

  • Support for third-party plugins, apps, integrations, or external tools

  • Strategy, branding, or conversion consulting

  • Fixing Squarespace platform issues

  • SEO setup

  • Full website setup outside the template

Support is available via email for 30 days after purchase

8. Your Responsibilities

You agree not to:

  • Upload harmful, offensive, or illegal content

  • Attempt to hack, disrupt, or misuse our site

  • Violate intellectual property rights

Violation may result in revoked access or legal action.

9. Intellectual Property

All templates, designs, graphics, and digital content are the intellectual property of Nikol Bodnarova Photography, trading as Visual Charm Web Design.

Purchasing a Product does not transfer ownership. You may not copy or redistribute our templates for commercial competition.

10. Third-Party Services

Our templates rely on Squarespace, a platform we do not control.
We are not responsible for:

  • Squarespace bugs

  • Website downtime

  • Account issues

Our website may include links to third-party sites. We are not responsible for their content or policies.

11. Disclaimer of Warranties

Our website and Products are provided “as is” and “as available.”

We do not guarantee that:

  • Our Products will meet your specific needs

  • Access will be uninterrupted

  • Templates will always remain compatible after Squarespace updates

12. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for loss of profits, data, revenue, or damages.

  • Our total liability will never exceed the amount you paid for the Product.

Using our templates is at your own risk.

13. Privacy

We process personal data according to our Privacy Policy, available at: www.visualcharmwebdesign.com/privacy-policy

14. Termination

Your license may be suspended or revoked if you violate these Terms.
If terminated, you must stop using the Product and delete all copies.

15. Indemnification

You agree to hold harmless Nikol Bodnarova Photography trading as Visual Charm Web Design from any claims arising from your misuse of our Products or website.

16. Governing Law & EU Dispute Resolution

These Terms are governed by the laws of the Slovak Republic.
Disputes will be resolved in Slovak courts.
